Terms of sale and licence

These terms are between you and MARGA CONCEPTS PTY LTD (ABN 34 703 565 119, "we"). They apply when you download, try or buy Zmarga. By using it you agree to them.
1. The trial
You can use Zmarga free for 30 days of use. A day counts only when you open the app. When the trial ends, Zmarga becomes read-only: you can still open and read your code, but not change it, until you enter a licence key. Your files are never altered or locked by the trial ending.
2. What a licence gives you
- A personal licence lets one named person use Zmarga, permanently, on any number of computers they use themselves.
- It includes the updates we release for one year from purchase. Versions released in that year are yours to keep and use for good.
- After that year you can renew for another year of updates at the renewal price then shown. Renewing is optional: without it, Zmarga keeps working and you keep the last version your licence covered.
- The licence is for you. You may use Zmarga for paid work and for any employer or client, but you may not share your key, resell it, or let other people use your licence.
3. What you may not do
Except where the law allows it regardless, you may not copy Zmarga for others, remove or work around its licence checks, or reverse engineer, decompile or modify it. Zmarga includes open-source components, which stay under their own licences, listed on the licences page.
4. Buying
Orders are processed by our reseller, FastSpring, which is the merchant of record: it takes payment, charges any applicable taxes and issues your receipt, under its own terms of sale. Prices are shown at checkout in US dollars. Your licence key is sent by email once payment completes.

6. Your code
Zmarga works on files on your computer. We never receive your code, and you keep all rights in it. You are responsible for keeping your own backups and for having permission to work on the code you open.
7. Warranty and liability
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
Subject to that, Zmarga is provided as it is. We do our best to make it reliable, but we do not promise it is free of errors or suitable for every purpose. To the extent the law allows, our total liability to you is limited to the amount you paid for your licence in the twelve months before the claim, and we are not liable for indirect or consequential loss, such as lost profits or lost data.
8. SAP
SAP and ABAP are trademarks of SAP SE. Zmarga is an independent product and is not affiliated with, endorsed by, or sponsored by SAP SE. Zmarga does not connect to SAP systems.
9. Changes to these terms
We may update these terms for future purchases. The terms in force when you bought your licence continue to apply to that licence.
10. Law
These terms are governed by the laws of Victoria, Australia, and the courts there have jurisdiction. This does not take away any right you have to bring a claim where you live.
